RESPONSE DATE: 10 days after posting

The National Institute of Standards and Technology (NIST) intends to negotiate on a base year plus three option year sole source contract, under the authority of FAR 13.106-1(b), with Wyatt Technology Corporation, located in Goleta, CA for Maintenance Services to a Light Scattering Suite.

Sole Source Justification is as follows:

Wyatt Technology, the manufacturer of a Light Scattering Instrument Suite, is the sole company that produces an instrument suite with the capabilities to measure particle size, molar mass, particle number, particle shape and particle charge with sample separation. These instruments are highly specialized and contain a myriad of proprietary technologies that require extensive training, knowledge, and experience to appropriately diagnose, service and repair. Wyatt Technologies instrument suite has provided the Biomolecular Measurement Division, with advanced analytical methods in support of NIST's Biomanufacturing Project.

Repairs previously conducted by Wyatt Technology necessitate highly complex equipment and proprietary procedures and may solely be performed in the company's factory. Furthermore, Wyatt Technology's proprietary software has a non-transferable license only available through the manufacturer. As such, Wyatt Technology is the only contractor that can repair and maintain the instrumentation to meet the Governments minimum standards on its five-instrument suite.

Market research has demonstrated that Wyatt Technology is the only source available to provide the maintenance service to meet the Government's requirementson these highly specialized instruments.

No solicitation package will not be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responsesto the Government for consideration. Responses received by latishwalker@nist.gov by 11:00am EST 11/18/2019, will be considered by the Government.

The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 811219 with a size standard of 20.5 Million.

Written responses to this synopsis shall contain sufficient documentation toestablish a bona fide capability to fulfil the requirement. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government.
